1. Subject matter of the contract


These general terms and conditions govern the short-term rental of the Resort of Spirit holiday home to private individuals for private recreational purposes. A binding rental agreement is concluded upon written booking confirmation from the landlord.



2. Booking & conclusion of contract


Bookings can be made in writing, by phone, or through official booking portals (e.g., Airbnb, Booking.com). The contract only becomes effective upon written confirmation from the landlord. Booking guests must be at least 18 years old. The minimum stay is two nights.



3. Terms of payment


To confirm your booking, a deposit of 50% of the total amount is required via bank transfer or PayPal. The remaining amount, plus a security deposit of €500, is due no later than one week before arrival. For short-notice bookings, the total amount, including the security deposit, is due immediately. The security deposit will be refunded via the same payment method within seven working days of departure, provided no damages are found.



4. Cancellation & Refund


Cancellation of the booking is possible at any time. The following refund conditions apply:


  • Up to 30 days before arrival: 100% refund
  • Up to 21 days before arrival: 70% refund
  • Up to 14 days before arrival: 50% refund
  • Up to 7 days before arrival: 10% refund
  • From 6 days before arrival: no refund


In the event of the death of a first-degree relative (parent, child, sibling, or partner), a generous refund may be granted upon presentation of official documentation. The decision is at the discretion of the landlord. There is no legal entitlement.


Note: We strongly recommend purchasing travel cancellation insurance. No specific provider is listed.



5. No-show & late arrival or departure


In case of no-show without prior cancellation, the entire booking amount remains due. Late arrival or early departure does not entitle you to a price reduction. In case of a late departure that was not agreed upon, an additional night's stay may be charged.



6. Arrival and Departure / Access


Check-in is possible from 4:00 PM. Check-out is by 10:00 AM at the latest. Access to the house is controlled via a secure key box.



7. Use of the holiday home & house rules


The holiday home can accommodate up to six people. Use is at your own risk.



House rules and code of conduct


General:


  • Treat the house with the same respect as your own home.
  • Consideration for the neighbors is a given – especially with regard to quiet times (from 10 p.m.) and behavior outside.
  • Please observe municipal regulations such as waste separation and waste disposal.
  • Always follow the instructions of the owner or property manager.



Dealing with energy and the environment:


  • Please heat consciously and do not leave any windows open when the heating is on.
  • Turn off the light when leaving a room.
  • Use water sparingly.



Bed linen:


  • For hygiene reasons, sleeping without bed linen is prohibited. Cleaning costs or replacement will be charged in case of violation.



Pets:


  • Animals are very welcome here.
  • A flat rate of €50.00 will be charged per animal.
  • Pets are not allowed to use furniture or beds.
  • Damage caused by pets will be deducted from the security deposit. If the damage exceeds the deposit amount, the tenant is fully liable.
  • If the permitted number of animals is exceeded or if significant disturbances occur, the stay may be terminated without refund.



Wellness area & facilities:


  • The infrared sauna, the Jacuzzi, the yoga towel and the acupressure mats are available for free use – but only if used properly.
  • Glass, dishes, food and drinks are not permitted in the sauna and jacuzzi.
  • The yoga towel may only be used while wearing clothing and may not be used with sharp-edged or abrasive objects (e.g. rivets, zippers, belts).
  • The acupressure mat should be cleaned with a cloth after each use.
  • Towels must always be placed underneath the sauna.



Departure – binding obligations for all guests:

Regardless of whether final cleaning is booked or included, the following applies to every guest:


  • The house must be handed over in a broom-clean condition.
  • Used bed linen must be removed.
  • The dishes must be placed in the dishwasher and switched on.
  • All electrical appliances used (including grills) must be cleaned.
  • Furniture must be returned to its original location.
  • Toilets must be left clean.
  • Waste must be completely separated and disposed of properly.



Additional cleaning costs will be charged or deducted from the deposit if the house is left in a more than usual state of contamination.


Note: The exterior of the house is under video surveillance for security reasons. The recordings are used solely for the protection of the property and are not stored permanently.


Please note that additional house rules may apply depending on the booking platform.



8. Liability & Insurance


The tenant is liable for all damage to the building, inventory, or property caused by him, his fellow travelers, or guests. Personal liability insurance is a prerequisite for booking. The landlord is not liable for lost or damaged personal belongings of the tenant.



9. Data protection


Personal data will be processed exclusively for the purpose of processing the rental agreement and will not be shared with third parties. The current privacy policy on the provider's website applies in accordance with the GDPR.



10. Choice of law & place of jurisdiction


The law of the Grand Duchy of Luxembourg applies. For consumers outside Luxembourg, mandatory consumer protection provisions of their home country remain unaffected.

The place of performance is Leithum, Luxembourg. The place of jurisdiction shall be governed by the statutory provisions.



11. Severability Clause


Should any provision of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by one that most closely approximates its economic purpose.
